By accessing and using MappedGarden ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

MappedGarden is a web-based application that allows users to:

• Design and plan garden layouts using a drag-and-drop interface
• Access a library of plants, vegetables, herbs, flowers, trees, and garden features
• Create garden designs during their current browser session
• Print or export garden layouts for reference
• Search and filter plants by category and characteristics

Important: Garden designs are not automatically saved between browser sessions. Users must export or print their designs if they wish to preserve them beyond their current session.

3. User Responsibilities

3.1 Appropriate Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use any automated means to access the Service without permission
• Attempt to reverse engineer, decompile, or disassemble the Service

3.2 Content Responsibility

You are solely responsible for the garden designs you create using the Service. We do not claim ownership of your designs, and you retain all rights to your creative work.

4. Intellectual Property Rights

4.1 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of MappedGarden and its licensors. The Service is protected by copyright, trademark, and other laws.

4.2 Plant Library

The plant library, including plant names, descriptions, and spacing information, is provided for informational purposes. While we strive for accuracy, we make no guarantees about the completeness or accuracy of this information.

4.3 User Content

You retain ownership of all garden designs you create. By using the Service, you grant us a non-exclusive, royalty-free license to use, store, and process your designs solely for the purpose of providing the Service to you.

5. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices. Your garden designs are not stored persistently and exist only during your current browser session. They are not transmitted to our servers unless you explicitly choose to export or share them.

6. Service Availability

We strive to provide continuous access to the Service, but we cannot guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical difficulties
• Force majeure events
• Updates or improvements to the Service

7. Disclaimer of Warranties

IN NO EVENT SHALL GARDEN LAYOUT VISUALIZER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

9. Garden Planning Disclaimer

Important: The Service is designed for planning and visualization purposes only. The plant information, spacing recommendations, and garden layouts provided are for general informational purposes and should not be considered professional gardening advice. Always consult with local gardening experts, extension services, or horticulturists for specific growing conditions, soil requirements, and plant care in your area.

10. Third-Party Content

The Service may contain advertisements or links to third-party websites or services that are not owned or controlled by MappedGarden. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Garden Layout Visualizer operates, without regard to its conflict of law provisions.
